Article 30 of the Karnataka Stamp Act, 1957 generally relates to leases of immovable property, including commercial premises. The applicable stamp duty depends on the actual terms, duration, rent, premium, deposit, and other relevant factors.

The correct article and stamp value should be confirmed before execution. Insufficient stamping can lead to additional duty, penalties, or restrictions on use as evidence.

Is Registration Compulsory?

Certain leases require registration under Section 17(1)(d) of the Registration Act, 1908, including leases from year to year, for a term exceeding one year, or reserving yearly rent. Other applicable requirements must be checked according to the transaction.

Stamping and registration are separate requirements. Paying stamp duty does not fulfil a compulsory registration requirement.

Is a Shop Rental Agreement Enough to Obtain a Business Licence or GST Registration?

A rental agreement may serve as supporting evidence of business premises, but acceptance depends on the relevant registration or licensing rules. Additional proof of ownership, landlord consent, utility bills, identity details, or other documents may be required.

A rental agreement does not itself grant every business licence or permission needed to operate.

Can the Rent or Business Terms Be Changed?

Yes, where the parties agree and the change is permitted by the contract and applicable law. Rent revisions, extensions, changes in permitted use, and other material amendments should be documented appropriately.

No. It records the agreed terms and may provide supporting evidence, but its legal effect depends on proper execution, applicable stamping and registration, the contract terms, and the facts of the dispute.
